Two years prior, New Zealand embarked on an ambitious public health initiative, introducing legislation aimed at phasing out tobacco sales for individuals born after January 2009. This legislative move was a part of the nation’s broader Smokefree 2025 Action Plan, designed to drastically reduce the accessibility and consumption of tobacco products, with a particular focus on cigarettes. The legislation encompassed all tobacco products, including cigars, and heralded a new era in the country’s public health policy.
The Smokefree plan was a symbolic gesture and came with stringent measures. These included a progressive increase in the legal age for purchasing tobacco – starting at 19 in 2025 and increasing annually until the eventual goal of making tobacco sales non-existent. Additionally, the plan outlined significant changes for the current tobacco market: a drastic reduction in the legal nicotine content in tobacco products, the restriction of tobacco sales to specialized retailers, and a substantial cut in the number of stores legally allowed to sell tobacco, from 6,000 to just 600 nationwide. Notably, these measures were not extended to vape sales.
However, the political landscape in New Zealand has since shifted. With the National Party now at the helm of a new coalition government, a stark reversal in policy appears imminent. The National party-led government, citing financial motivations, has announced plans to scrap both the generational ban and the stringent restrictions that were part of the Smokefree plan. This decision is primarily driven by the desire to recuperate tax revenues lost due to the proposed tobacco restrictions.
Nicola Willis, the new finance minister, emphasized the financial implications of the Smokefree legislation, noting its significant impact on government finances – approximately $1 billion. Willis announced on New Zealand’s TV3 Newshub Nation that the government expects to revoke these measures by March of the following year, foreseeing a substantial boost in government revenue.
Prime Minister Christopher Luxon further justified the policy reversal, suggesting that maintaining the tobacco ban could lead to the emergence of a black market and highlighting the challenges in enforcing the proposed age restrictions.
New Zealand’s initial move to implement a generational tobacco ban was pioneering, though it is no longer unique. Similar legislative proposals have surfaced in other regions, such as California and New York State, albeit with varying degrees of success.
Repealing the New Zealand laws is still underway and requires parliamentary action. Given the majority held by the coalition government, a swift repeal is anticipated. This development marks a significant shift in New Zealand’s approach to public health and tobacco control, reflecting the complex interplay between health policy and economic considerations.
